What does a title search look for?
Recorded documents affecting the property: deeds, mortgages, liens, judgments, easements, restrictions, plats, and in practice municipal liens and open permits. Problems found are listed as requirements or exceptions in the title commitment.
Do I need an owner's title policy if my lender already requires one?
The lender's policy protects only the lender. An owner's policy protects you. The CFPB notes you may want an owner's policy to help protect your investment, and that buying both policies from the same provider at the same time is usually cheaper.
How much are documentary stamps on a Florida deed?
70 cents per $100 of consideration (or portion thereof) in every county except Miami-Dade. In Miami-Dade the rate is 60 cents per $100, plus a 45-cent surtax unless the property is a single-family residence. Try our doc stamp calculator.
What taxes apply to a new mortgage?
Documentary stamp tax of 35 cents per $100 on the note or mortgage, and nonrecurring intangible tax of 2 mills (0.2%) on obligations secured by Florida real property.
How long does a condo or HOA estoppel take?
Florida law requires the association to issue an estoppel certificate within 10 business days after a written or electronic request (sections 718.116(8) and 720.30851).
Who pays for title insurance in South Florida?
It's set by your contract. Custom differs by county, so check the title evidence paragraph of the purchase contract.
Can my spouse's signature be required if only my name is on the deed?
If the property is your Florida homestead and you are married, the Florida Constitution generally requires your spouse to join in a sale or mortgage. See our homestead joinder article.
